Terms of Service.

1. Acceptance of Terms

By accessing or using the services provided by PowerData, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. Description of Service

PowerData provides technical marketing architecture, including but not limited to Server-Side GTM setups, GA4 implementations, conversion tracking, and data consultation ("Services").

3. Client Responsibilities

In order for us to deliver our Services effectively, clients must provide necessary access permissions to platforms (e.g., GTM, GA4, Ads platforms, Server environments). Clients are responsible for ensuring that they have the legal right to collect and process data on their own websites and that they have appropriate privacy policies and consent management platforms in place.

4. Intellectual Property

The custom tracking plans, standard operating procedures, and code architectures developed by PowerData remain the intellectual property of PowerData until full payment has been received, at which point a perpetual, non-exclusive license is granted to the client for use within their own business operations. PowerData website content and branding are the exclusive property of PowerData.

5. Limitation of Liability

While we strive for absolute precision, PowerData shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services. Ad platform algorithms change frequently; we cannot guarantee specific ROAS outcomes, only the accuracy of the data signals we send them.

6. Service Warranties

Our setups undergo rigorous QA. We warrant that delivered architectures function according to the agreed tracking plan at the time of handover. We do not warrant that architectures will remain functional indefinitely if third-party platforms change their APIs or if the client alters their website structure post-handover without engaging our ongoing support services.

7. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which PowerData primarily operates, without regard to its conflict of law provisions.
